CSS Projects, Oil & Energy Undertakes Transport of Hatch Cover

The team at CSS Projects, Oil & Energy, recently undertook a hatch cover movement from Jebel Ali port to the dry docks Dubai. The weight of the cargo was 24 tons with dimensions 13.25 x 8.20 x 1.10 m. The width of the cargo in this case was the main criterion to be looked into. The entire operation had to be scheduled meticulously as it had to connect a vessel coming in for repairs at the Dubai dry docks. The team received the unit from vessel directly and had to move the unit on wide body low bed trailer with special permissions  and during specific timings provided by RTA (1 AM – 3 AM) with police escorts. The efficiency of the Dubai police system was once again displayed when they tactically handled the traffic critical control points for the safe passage of this unit throughout the movement ensuring least difficulty to the other road users. “High professionalism has to be displayed in handling critical jobs in Projects. The proven expertise and commitment could be the major factors why people rely on CSS Projects team when it comes to complicated assignments”, commented Raj George Sr. VP, Projects Oil & Energy, when he was asked about this particular move by Lighthouse.

CSS Group to Celebrate 20th Anniversary

Consolidated Shipping Group will be celebrating 20th anniversary of operations in the field of Shipping and logistics during the month of March 2015. The entire team at CSS is excited at this land mark occasion, as they see this as a great success in their company’s career. The senior management announced the function last month and preparations are underway to make the event memorable.

New Corporate Video in The Making

CSS CORPORATE VIDEO-SHOOT IN DUBAI

CSS Group offices witnessed the new corporate video in the making for CSS Group. The programme was in relation to their forthcoming 20th anniversary celebrations going to be held in Dubai during the month of March. Lemon studios, Kochi, Kerala were engaged with the assignment of the corporate video production. Renowned technicians from the corporate world were engaged with the video shoot and production programme. The first schedule of the shooting was completed at the CSS Group offices in Jebel Ali, Cargo Village, DAFZA, Creek customs office and the Head office in Oud Metha buildings during the month of December. The video is planned to be released during the 20th anniversary functions. The forthcoming movie will unveil CSS Group activities and their facilities to a large extend to their clients. The Corporate video will be circulated then for the marketing & sales purposes.

Delhi Needs A Major Facelift to Handle More Cargo

FREIGHT FORWARDING FRATERNITY EXPECTS THE GOVERNMENT TO RIGHTLY INTERVENE

Delhi, India’s political Capital is also one of the largest business hubs of India after Mumbai, Business Capital of India. Delhi handles almost 27-32% of EXIM trade but as this is dry port the operational constrain is one of the biggest setbacks for Delhi EXIM trade. In recent days EXIM trade is facing tremendous problems due to majorly two reasons. One of them is rail connectivity with ocean ports. The seaports in India which caters most of the cargo for Delhi EXIM is either Pipava, Mundra or Mumbai ( NSICT/JNPT & GTIL), but the movement of containerized cargo to & from these ports are severely damaged due to mainly two reasons. One being 15-17% increase of import volume to India and drop in export cargo and the second being the lack of proper infrastructure and trains of CONCOR ( Container Corporation of India) and CWC ( Central Warehousing Corporation).

Now the situation has become so worse that any containerized cargo has a minimum stoppage time of 25-30 days in all of the above sea ports. Also due to new regulation imposed by Delhi Police effective 1st August no road movement of container cargo can be done within Delhi adds up the problem. Apart from the movement circulation another biggest setback is the lack of infrastructure for handling containers at ICD TKD & ICD PPG ( Two major ports of Delhi NCR region).

There is no major infrastructure development from last almost 10 years in these two major ports of Delhi Region. The present infrastructure of these two ports can only handle 2000 & 1000 teus respectively but now due to expansion in Delhi EXIM trade these two ports are forced to handle more than five times of their stipulated capacity. As a result of the same the stuffing and de-stuffing of containerized cargo takes unlimited days to complete which further worsen the situation day by day. Now the situation goes to the extreme standstill level that warehouses and yards are overloaded & no space for cargo handling.

All are forced to commence work in abnormal ways just to keep the movement flowing.

In these adverse conditions the only hope for the Freight forwarding fraternity is that concerned authorities should intervene to solve the problems and create hassle free channels to make containerized cargo move more smoothly.

Move and Prove

CSS MOVED MACHINERY FROM MYANMAR TO DUBAI FOR RITCHIE BROTHERS
CSS Plant and Machinery division making further inroads in the global shipping and logistics arena and is now recognized as a major player in this market segment.
To substantiate this CSS Dubai was brought, by Ritchie Brothers Corporate, into a major purchase contract between Ritchie Brothers and a major seller which entailed CSS being an integral part of a complicated pre-purchase contract as well as the actual equipment movement from the site at Myanmar to Ritchie’s auction yard Dubai.
“It is pleasing to see our specialist business unit, Plant and Equipment Logistics, being brought into very complex purchases and contracts as well us being given full authority by a very important customer to meet and negotiate with all major stake holders in order to get deals done and machines shipped to RBA Dubai”, commented Ken Dinnadge, VP Business Development, CSS Group.
He also added that “Obviously we were able to achieve this, given the support of our specialist team here in Dubai as we are well used to complex vessel fixtures as well as facilitating major elements of pre purchase contracts. This involved CSS being flown to Myanmar as the Logistics and adviser/partners for Ritchie Brothers and as an integral part of the whole negotiation and vessel fixture process”. The first phase was completed which included all stake holders were on board and the vessel fixed.
THE MAIN WORK THEN STARTED INCLUDES:

  • Preparing the equipment to be shipped
  • Vessel coming in on time
  • Cargo loading
  • Clearance and delivery to RBA’s yard Jebel Ali.

CSS Group KPL Dubai Season 3 Concludes in Style

KOLLAM KERNELS WALKS BACK WITH KPL DUBAI SEASON 3 TROPHY



One Stop Tourism L.L.C Kollam Kernels clinched the CSS Group KPL Dubai Season 3 title after defeating Seven Seas Trivandrum Royals by three wickets in a thrilling final at the ICC Academy Ground on Friday night, 21st November 2014.

Umar Ali Khan turned out to be Kollam’s star by smashing a spectacular half century which helped his team achieve the target of 189 in 19.1 overs. Trivandrum, which batted first after winning the toss, reached a good total of 188 for the loss of six wickets in 20 overs, thanks to a 19-ball 50 from Waheed Ahmed, who smashed one four and five sixes to entertain the weekend crowd.

Openers Waseem Rana and Sangeeth Joseph gave a 68-run opening stand to Trivandrum. Rana played an aggressive knock and smashed five boundaries and two sixes in his 18-ball 38, while Joseph gave good support by chipping in with 22 from 19 balls with the help of two hits to the fence.

Though Ibrahim (nine) fell cheaply, HasnainRaza (23) and Jeevan (22) contributed some useful runs before Ahmed blasted his half century and helped Trivandrum reach a good total in the final. Ahmed remained not out while Touqier was unbeaten on three.

Asif Mumtaz picked up two wickets for 35 runs from his four overs, while Rohan Mustafa, Vishnu and Atta bagged one wicket each.

The final day saw a glamorous line up of KPL Dubai ambassadors and other celebrities including CSS Group Chairman T S Kaladharan on the stage giving away the prestigious awards. KPL Dubai Directors were also present at the function.

Renowned musical band “Avial” performed after the match was over till midnight scintillating the joyous crowd at the ICC academy. Gifts for the spectators included bumper  raffle draw for Nissan car and gold. The event was hosted by Hit 98.7 and supported by Josh FM.

The Decision of The European Court of Human Rights – Review Needed??

The decision of the European Court of Human Rights (ECHR) comes as an insult to all Seafarers who survived Piracy attacks.  Recently the French government was ordered to pay a good amount as compensation to the pirates from Somalia who attacked French ships on the ground that their human rights were disregarded at the time of their arrest.

Further, to add on to this the ECHR ruled out that Denmark had to compensate nine suspects from Somalia who tried to hijack a Danish tanker vessel in the Indian Ocean, and the reason being that they were detained too long before bringing them before a judge.  As a result, each of them received $ 3,247 for the days they were detained.

The Judgement states that as per Danish law, a citizen cannot be held in custody for more than a day without being presented before a judge.  However, there arose a question why does this rule apply to them since they are neither citizens of Denmark or the European Union.  While deciding on such cases, seldom do the judges notice the threat the pirates or rather these armed criminals cause to the seafarers and their families.  Here in fact, Judges use law to protect these criminals instead of punishing them.  The naked truth is that the pirates actually take away the human rights of the seafarers when they captivate them and never have been the seafarers compensated.

There have been instances where the seafarers were held for 1000 days and more, but there was no ECHR to hear them and grant them a compensation for their suffering.  There are 30 seafarers and fishermen who are held for four years without receiving any compensation, not even their wages.  Nevertheless, the pirates were supported by giving them $ 250 per day for being held.  There have been voices in the Shipping Industry against these kinds of judgements and support for the seafarers and their families.

The Maritime Piracy Humanitarian Response Programme (MPHRP) was set up in 2010 to support and assist the seafarers and also for their welfare. It is an alliance of ship owners, managers, manning agents, insurers, maritime unions, and professional and welfare associations together with governmental and intergovernmental organizations.

The situation of piracy cases and attacks are no different in Asia.  During November 2014, a total of 20 piracy attacks were reported of which, maximum number occurred during June 2014 and the minimum in January 2014. Among these 20 incidents, 11 occurred onboard ships in the Straits of Malacca and Singapore and in the South China Sea and the rest occurred onboard ships while anchored/berthed in the South China Sea, Cochin and Sandheads anchorages in India, Chinagong port, Bangladesh, Samarinda anchorage, East Kalimantan, Indonesia and Vung Tau, Vietnam.

Euphemistically Speaking Have A Good One !

Well here we are having no doubt enjoyed unwrapping our seasonal presents. Whilst it is often said, when it comes to giving gifts, it is the thought that counts equally it is the conversation that the gift triggers that matters just as much. I recall a hospital patient, upon receiving several large boxes of chocolates, saying to her visitor: – “Oh you shouldn’t have spent your money on all of these for me”. But this was not the real meaning of her words. What she actually meant was: – “It makes me happy that you have done this”.  This difference in what we sayand what we really mean is euphemism in action!

The word euphemism originated from the Greek word “euphemia” meaning “the use of words of good omen.”Their use occurs in all languages but English is reputed to take the prize, as world champions, for using them the most. Whilst all languages have a plethora of abrupt short terms that emphasise big points, so as to make their meaning clear, it is sometimes preferable to soften the impact with a euphemism. Replacing possibly upsetting terms with a euphemism is generally considered to be polite.  For example the western world’s yearning for bodily perfection and longevity gives rise to, ‘cuddly’ really meaning ‘fat’ and ‘follically challenged’ meaning ‘bald’. You no doubt will agree that these terms sound more polite.

English is particularly difficult to understand,when it comes to the use of euphemisms, as the real meaning can change according to the pitch, speed and inflection of the spoken words. The late English novelist, George Orwell is quoted as saying that euphemisms can be sneaky and coercive.  A ‘major problem’ seems less alarming when it is called a ‘challenging issue’.

In politics, politically correct euphemisms now rule the roost and have become pervasive.  Instead of using, ‘good or bad’, politicians have replaced them with ‘appropriate or inappropriate’. They sound better don’t they?

Euphemisms are so firmly established in British speech that foreigners, even those who speak fluent English, may miss the true meaning.  Here are two of my favourite examples:-

When the British say: -“With the greatest respect”.
What is understood: – “Apologising for having a different opinion”.
What is meant: – “You are mistaken and being somewhat stupid”.
When the British say: – “I will keep it in mind”.
What is understood: – “They will probably do this”.
What is meant: – “I will almost certainly ignore this”.

There are so many examples in all areas of life and in all languages, but a particular saying at this time of year is: “It’s just what I always wanted”. In euphemistic circles this phrase is as hollow as any that was ever uttered by Charles Dickens’ Scrooge.  Funnily enough London has been namedas the capital of unwanted Christmas presents. New Year sees the pages of UK eBay full of unused and unwanted presents, being sold-on as second-hand bargains.

Realistically languages without euphemisms would be much more honest but at the same time they would be more brutal and upsetting.  Perhaps this New Year you might try getting through a whole day without using any euphemisms in your conversation. The results will undoubtedly surprise you. It simply isn’t that easy.

Fortunately there is an English phrase that, no matter how hard you try to say it differently, still keeps its real meaning.“Have a good one”, means exactly what it says. So to all our Lighthouse Kaleidoscope readers may we say to you, with totally no euphemisms implied or meant … “New Year 2015 – have a good one!”

Chairman’s Message

Whenever I talk about cricket I am exhilarated. For many of us, cricket holds a special place in our hearts. The sound of leather hitting willow gives us a feeling of unity and purpose, triggering emotions that transverse cultures and nations. Considering how CSS enjoyed a glorious past in UAE cricket, we are able to welcome this season’s Kerala Premier League with deserved pride. In many ways my happiness is boundless because, this year, CSS Group is KPL’s title sponsor, especially while we walk towards our 20th Anniversary.
Like all sports, cricket has its ups and downs but here we are at CSS Group KPL Season 3. It’s something of an irony that once you are hooked, cricket never leaves you and you certainly cannot leave cricket. A love of cricket grasps your heart.  KPL Dubai season 3 has gained a wonderful response from the cricketing fraternity. 12 teams from 12 districts of Kerala are competing for the coveted trophy. The patronage we received from the media was boundless. The corporate world also supported us with generous sponsorship. Although the KPL matches will be half way through when you read this message, I feel that this is an opportune time to say, “Thank you”, to all those who have supported this event.
From the bottom of my heart I welcome you all to the ICC Grounds, to cheer on the enthusiastically competitive teams. CSS Group KPL Dubai Season 3

KPL ENTERS SEASON 3 WITH CSS GROUP AS THE MAIN SPONSOR OF THE EVENT
CSS Group KPL Dubai Season 3 kicked off to a glittering & glamorous start on the 17th October at the ICC Grounds, Sports city Dubai. The inaugural function which was attended by celebrities and dignitaries from DCC went off with a colorful performance from DJ Kips & Music Band Masala Coffee. The toss went up at 7:30 in the evening for which hundreds of fans from both Palakkad Harvestors and Cochin Diwans, who played the first match witnessed. KPL Directors, T S Kaladharan, CTK Nasir, Paul T Joseph & Thomas Philip were present on the ground. KPL convener Radhakrishnan (Radhu) narrated the events from the ground. KPL Director & ambassador Bharat Suresh Gopi, Narain & Bhama cheered the onlookers. Josh FM 97.8 RJ Parikshith did live programme from the venue. Friends from the media, and other team members and owners were present for the function.

A total of 12 Glorious Teams named with 12 Districts from Kerala is playing the tournament for the coveted KPL trophy. Each team consists of a minimum of 2 players preferable from the respective districts of Kerala in a playing XI and the remaining from local talent with one player under the age of 22 and maximum of 2 overseas players.

KPL Dubai is the biggest Asian sporting event of the region and it gives you the opportunity to be known to and reach, one of the largest communities in the region. After the super hit Indian Premier League and in consideration of the 4.5 million Asian populations in the UAE – the highest number among all expats, Kerala Premier League Dubai was formed under the guidance and support from the Dubai Cricket Council, and the generous patronage from the sponsors and the cricket loving community in Dubai. KPL successfully completed 2 seasons of cricketing festival in Dubai and has entered the third season with a bang. The final will be played on the 21st November 2014.

Fayaz Ahmed is a UAE player presently playing and is in squad for world cup 2015. Fayaz is rated as a top left arm all-rounder in the UAE. He is playing his second season of KPL Dubai with Alleppey ripples team. Fayaz’s presence gives an international outlook for the entire team.


SHAHZAD MALIK
Shahzad is considered as a top class batsman in the UAE with plenty of experience in all levels of domestic and international cricket.  He holds the record of scoring 403 in 45 over official game. His experience as a batsman and conditional seasoning career will be reflected in the teams performance.


BABAR MALIK
Babar represented UAE from 1996 upto 2002. He also represented A division clubs like Emirates bank, ECB, Eurocon, Al kabeer and Ibsons. Babar is known for his exemplary batting skills and a powerful hitter when it comes to T20. He is playing with Alleppey Ripples for the Second season.


AHMED SHAUKAT
Ahmed played for Multan region and is considered to be one of the best all rounders currently playing in the UAE. Ahmed being a very good fast bowler, could  strengthen the bowling line up of Alleppey ripples.


HABIB GHAZI
Habib Ghazi has a wonderful experience in playing club cricket in Ireland for over 7 years which has sharpened his skills in cricket. He also enjoys a tremendous success with Ibsons and is a live wire on the field. Habib is playing his first season of KPL.


ZAKIR MALIK
Zakir is a wonderful batting talent with some hard hitting skills. His experience starts from the Navy cricket team of Pakistan till this date. Zakir Malik is now representing alubond tigers in the local cricket.


IRFAN SAJID
Irfan is a name you can rely on in the middle order when it comes to batting. A highly talented leg spinner, Irfan is being named amongst the 20 players currently in the UAE pool for the world cup.




MOHSIN KHAN
Mohsin Khan a very talented fast bowler and an exemplary fielder has represented the under 19 squad of the UAE in various occasions. He has also played for Farooq Cricket Club in A Division tournaments.


HAREESH M HARIDAS (CAPTAIN)
A well known name in the cricketing community of UAE, Hareesh has represented Kerala Under- 21 to Under 23 squad from the year 1993 to 1996. Hareesh is a highly talented batsman who can change the game any time. He has played for Tellicherry Cricket Club & Team CSS in UAE for almost all the Domestics A and B Division tournaments and in various formats.


WASIM BAIG
Waseem Baig is from the Gujarat city of Pakistan and has a wonderful cricketing career history in first class matches back home. He plays middle order in Ibsons club and is one of the best finishers of game and a brilliant fielder plus a handy off spin bowler.


MISBA KHAN
Misba at his young age acquired plenty of experience. He is a fighter cricketer having all round skills. Misba is good in his right arm off-spin and is a reliable bowler for Alleppey ripples. This is his first KPL appearance and is belligerent with his tactics. He can show us some wonderful cricket this season.


MOHAMMED SHAFIQ
A person with lot of experiences with legends of Pakistan Cricket, and that is Mohammed Shafiq. Inzamam-Ul Haq and Mushtaq Ahmed were regular players under his captaincy while he led the Multan region. Played under 19 for Pakistan and represented Pakistan A team and the UAE international team.


ANEESH KAKKOT
Aneesh has been Prolific run getter in the domestic circuit and a fine all rounder representing UAE-Exchange Centre in UAE. Live wire in the field. This will be his second season for the Alleppey Ripples.


IRFAN AKRAM HAJI
Haji doesn’t require an introduction in the UAE because of his all-round performance past many years. Run machine by himself and orthodox left arm medium pace consider him as a one of the most dynamic cricketer in the cricketing circles. Continuing for the third consecutive year for Alleppey Ripples Team.


NIGIL KALLIAT
Nigil, a silent by nature and electrifying player in the field, a spirited young man with good cricketing brain, can be considered as a total cricketer by all means. He has been an Integral part of Team CSS in the past and continue his service for CSS on and off the cricketing feild.


MUKHTAR AHMED
Star right-handed batsman Mukhtar Ahmed’s presence would be an added advantage for Team Alleppey ripples.With a wonderful batting record in domestics circuit, Mukhtar played some remarkable innings with Pakistani National players.Mukhar is a leg-spin bowler as well.


MADAN MOHAN
Having cricket in his veins Madan Mohan started his cricketing career playing for the Kerala under 19 team during 2005-2006. He played for various prominent clubs and also for Kerala team under-25. Being an all-rounder with capabilities as left hand batsman and right arm fast medium bowler, Madan has played for Kerala team in the CCL for the last two years


ROHAN FERNANDEZ
Trained under world class coaches, Rohan is a trusted spin bowler with Alleppey Ripples. A promising and upcoming player, Rohan has showed his presence with some remarkable spells in the 3rd division matches for the Tamil Nadu Cricket Association recognised club matches. KPL will prove to be a testing ground for this spinner with some international experience.

Alleppey Ripples jointly owned by Kaddas interiors Abu Dhabi and Twin info solutions Pvt Ltd, India is entering its third KPL season. The team is owned by Arjun Bose, who is also the Director for CSS Abu Dhabi. Arjun holds stake in Kaddas Interiors and Twin Info as well.


The team is managed by Fida asghar, renowned cricketer who carries with him first class career experience in Indian Cricket.

Hareesh M Haridas a well known name in the cricketing circuit of UAE leads the team of Alleppey Ripples. Hareesh with his rich experience in domestic cricketing circuit is a well known bats man in the UAE.

As a team, Alleppey Ripples takes pride in having players who have rich experience and blasting career history, from India, Pakistan & UAE. The team has performed well in the last two seasons of KPL and had reached the semifinals.

Alleppey Ripples ownership has been over taken this year by two well known companies from their respective domains. Kaddas Interiors, Abu Dhabi is a renowned interior design and installation company. They have diversified interests in AV integration and automation as well. Kaddas Interiors renders their services for residential as well as commercial projects in the UAE region. Fida Asghar (Manager)

A wonderful cricketer who had played in the first class cricket, Fida, by nature, takes cricket to his heart. The manager’s role is safe in his hands. Fida Asghar represented Kerala state for Under 17, 19, 21, 23 and seniors. He played first class cricket representing Kerala state for the Ranji trophy tournament from 1990-93. Fida never missed the opportunity to represent MG university team during the period, 1988-90. Fida is a Right hand batsman and a wonderful Wicket keeper

Arjun Bose (Team Owner)

Arjun Bose is the owner of Alleppey Ripples. An ardent cricket lover and player, Arjun plays an inspirational role amongst the Alleppey ripples team. A stake holder of Kaddas Interiors and Twin Info, Arjun plays a bigger role of being the Director of CSS Abu Dhabi. Despite his busy business schedule, he always finds time to be with and inspire the team of Alleppey ripples whenever he is in Dubai. The astonishing performance of the team took them to semifinals in the first two seasons of KPL and Arjun believes that this time his team will lift the trophy for sure.

About the destination:

Paphos is a coastal city in the southwest of Cyprus and the capital of Paphos District. In antiquity, two locations were called Paphos: Old Paphos and New Paphos. CSS Homeward Bound Supports Dubai Inter School Cricket

The inter school cricket tournament in Dubai was sponsored by CSS Homeward Bound from the title position. Ten schools, divided in two groups of five each, were contesting for the top prize.

The draw for the Under-16 students’ tournament was held at the Shangrila hotel in Dubai.

Dubai International Academy, GEMS Modern Academy, Our Own High School, English Language School and HH Sheikh Rashid Al Maktoum Pakistani School were drawn in Group A while the Elite English School, Arab Unity School, Indian High School, Delhi Private School (Dubai) and The Winchester School were placed in Group B.

The inter-school cricket tournament has CSS Homeward Bound as the main sponsor. The event is supported by Smart Bag, Petrotech, MyCricket.ae and AreaSqft.com among others.

The Press conference was attended by Walid Bukhatir, Chairman of the Domestic Cricket Development Committee, Mazhar Khan of the Emirates Cricket Board among other dignitaries. CSS Group was represented by Suku Sudhakaran, General Manager CSS Homeward Bound, Syed Zeeshan, General Manager CSS Homeward Bound and G Unnikrishnan, Marketing & Corporate Communications Head for CSS group.

In a thrilling competition, this year also CSS Abu Dhabi won the Mahabali Crystal Award for the best flower carpet (Pookkalam).

Every year, in connection with Onam celebrations, at CSS Group, a competition is being held among all offices for bagging the best creator of Pookkalam on the main day of Onam, ie; Thiruvonam. Each office engages their best team to making amazingly beautiful designs only with flower and take photographs to be sent to a judging panel comprising of renowned people from art, music & cinema. Beware and Be Aware of Packing of Flexible Tank

A Shipper in a standard bills of lading is responsible for the “Load, Stow and Count” of his cargo/consignment and hence if the Shipper intends on using a Flexitank to transport his consignment he should discuss with a flexitank operator the most suitable type of flexitank that will be compatible with the product to be shipped. Here the Shipper must also provide vital information detailing of the nature of the product and whether it could ‘solidify’, ‘taint’ or ‘damage’ the container in the event of a leakage, etc.
Though the carrier has a duty to “properly and carefully load, handle, stow, carry and keep, care for and discharge the goods carried” the task of proving the same is a different matter; in the event you are able to prove that the carrier is liable, keep in mind that most carriers have a limitation of liability clause in their respective Bills of lading which will not be sufficient to cover the claimed amount.
Therefore it is upon the Shipper/Freight Forwarder/packers to protect their interest by take pictures of the empty container and at various stages during stuffing. As these photographs can be relied upon, in the event of a claim and to prove that special attention and measures were taken in relation to packing, securing and protecting the Flexitank and consignment within the container. Further it is also essential to insist on adequate Insurance to be obtained for the cargo/consignment
It is far easier for the carrier to tactfully rid themselves of liability by taking a defense that the consignment was inadequately packed. In such instances all valid information that precautions were taken can definitely help to rebut this defense.
In the unfortunate event of leakage or a potential claim the party receiving the consignment must accept delivery under protest and immediately put the carrier and insurer on notice, calling upon them to attend a joint survey. As an added precaution it is also advisable to put the shipper, consignee and all parties involved in the carriage on notice.
As far as possible it is also better to open the container only at the time of the joint survey, in the presence of all concerned parties. Ensure that all the details pertaining to the damage are inspected and recorded before the container is returned.
In most claim cases pertaining to Flexitanks the carriers will also claim all incidental cost in relation to damages, cost for clean up, and other charges caused due to the leakage of the consignment; from the shipper and/or consignee and/or the booking party.
A note of caution to all freight forwarder and Non Vessel Operating Common Carrier (NVOCC), is to bear in mind that even though you may not be involved in the packing or stowing of the consignment, you can be faced with a claim for damage not only from the Shipper and/or Consignee but also from the Carrier. Hence it is always advisable to have an adequate insurance cover for such cases.
Ultimately the claims arising from the use of Flexitanks can be mitigated to a great extent by taking abundant caution and care and by engaging the services of a professional while exporting consignments using Flexible Tanks. It addition it is high time to have a statute to govern all aspects pertaining to Flexitank from the material to be use for manufacturing such tanks, to the packing, stowing, loading requirement, the specification on the load limit and the kind of container, proper labeling, etc, with the ultimate aim of roping in the packers and also holding them liable in case of potential claims.

Sledging is not Just for Children…

When I was a youngster I spent many happy hours, with my friends, building a sledge out of bits of wood. Somehow we managed to fly down slops, in summer sledging over short grass and in winter across firm snow, without breaking our necks! However, in recent years,‘sledging’ has gained greater prominence with cricket aficionados.This term apparently originated in the 60’s when Australian bowler Grahame Corling wasserenadedby some players singing ‘When a man loves a woman’- at that time a hit by USA soul singer Percy Sledge.  It was attempt to taunt Corling so as to distract him from focusing on his play. Since then this practice, of trying to weaken an opponent’s concentration, has taken on the surname of Percy Sledge by being called ‘sledging’. Other sports have methods of distracting a competitor’s attention but the technique in cricket is unique. To understand thisit is necessary to explore cricket’s history. Despite the apparent recent popularity of sledging, the practice of witty banter between players is as old as cricket itself. Therein lies the difference between cricket and other sports. Ever since John McEnroe’s infamous outburst, on the tennis courts in Stockholm in 1984, the nature of goading in sport has risen to a level at which no genuine cricket fan would approve. The reason for this is based in cricket’s past.  The first recorded cricket match took place in Kent, England in 1646. The game quickly became popular with the first ‘laws of cricket’ being established in 1744. The thrust of them focused on “gentlemen” playing the game. Subsequently conduct, on and off the pitch, required that all participants, players and spectators, behaved in an acceptable gentlemanly manner. Honour and integrity were at the forefront of play. A player never argued with the umpire. If you were given out – you walked! Generations of UK schoolboys had it drummed into them that,even if you felt you had been wrongly dismissed, you did not argue with the umpire’s decision. It probably made-up for all the times you should have given out and weren’t! Accordingly gentlemanly conduct ruled supreme. There is now an on-going debate, in the cricketing world, as to what constitutes poor sportsmanship or good humoured banter. Anything which descends to abuse is unacceptable. This is not what sledging is all about as it should never cross the sportsmanship line. Sledging should be kept to humorous, sometimes slightly off the wall remarks and clever verbal attempts in order to distract an opponent.

Sledging has always been a part of cricket as even the legendary W G Grace did it. Grace’s determination to stand his ground would have made Sunil Gavaskar proud. When a ball knocked off one of his bails Grace replaced it and told the umpire that it was the wind which took the bail off. The umpire replied, “Indeed Dr. Grace and let us hope the wind helps you on your journey back to the pavilion”. Grace walked with good humour.

Interestingly it is usually accepted that Indian cricketers, unlike the Aussies who love it, don’tsledge very much.  There is one notable occasion, when the tables were turned and Ravi Shastri sledged Mike Whitney who was the Australian 12th man. Trying to snatch a single run Whitney shouted, “If you leave the crease I’ll break your blinking head”. Shastri quickly retorted, “If you could bat as well as you can talk, you wouldn’t be the blinking 12th man”.  You do, of course, have my permission to assume that the language used was slightly more colourful!

I always prefer and chuckle at the short, sharp retorts. This is why I choose, as a favourite, one from‘Fiery Fred’ Trueman probably the most revered English bowler. As an Australian batsman was walking onto the field, he opened the gate and before he could shut it, Trueman shouted, “Don’t bother shutting it son, you won’t be here long enough”.

Cricket remains a game where many of us still hope our children are taught that it is not winning that counts the most.  Rather it is playing a sportsman-like match which matters more. An extract from a poem by former UK Prime Minister John Major, an ardent cricket enthusiast, sums up this cricketing ethos. It was written as a tribute to England test cricketer, Colin Cowdrey, who was born in Bangalore.

“The mellow sound of bat on ball,
The wherewithal to enthrall,
The master with a Corinthian touch,
To whom victory mattered, but not that much”.

Hopefully, with this in mind, you will agree that sledging should remain as witty banter that enhances the traditions of the cricketing spirit.
